法治政府视阈下公安执法“法律方法”运用研究

摘　　要：党的二十大报告提出的法治政府建设离不开公安机关的执法参与。公安执法能力建设需要法律方法的思维指引。公安执法从学理上可划分为“找法”“讲法”“说理”三个环节,分别主要运用法律发现、法律解释和法律论证方法。法律方法的公安实践运用有助于法治公安和法治政府建设。The report of the twentieth CPC National Congress instructs the development of law-governed government can’t be separated from the participation of police agencies’law enforcement.Therefore,the fosterage of police law enforcement competence needs to be ideologically guided by legal methodology.The police Law enforcement can be in doctrine categorized into three steps:"law finding","law interpretation"and"reasoning",each of which has to use proper methods to find the law,interpret the law and prove it.The use of a proper legal method is undoubtedly helpful to the development of law-governed police and law-governed government.
