摘 要:七人合议制作为解决人民陪审员参审有效性问题的重大制度创新,承载着利用社情民意优势解决重大案件的功能。从实践的情况来看,在《人民陪审员法》颁布之后适用七人合议庭的案件数量明显增加,绝大多数适用七人合议庭的案件属于刑事附带民事公益诉讼案件,集中于破坏环境资源保护类案件。对于公益诉讼案件与重大刑事案件的适用标准不一,重大刑事案件大多由于不属于“社会影响重大”而不适用七人合议庭。有必要重新思考七人合议庭的性质定位,使七人合议庭的适用成为刑事案件当事人依法申请的权利,只要当事人申请适用,法院即应当组成七人合议庭进行审理。The seven member collegiate system is a major institutional innovation to realize the effective engagement of people’s jurors in the trial,and bears the function of judgement in accordance with public opinions.In practice,the cases applicable to seven member collegiate panel has significantly increased since the implementation of the Law on People’s Jurors.Most of them are criminal incidental civil public interest litigation,mainly in the cases of environmental destruction and resource protection.Public interest litigation cases and major criminal cases are treated differently by standards.Most major criminal cases are not applicable to seven member collegiate panel because of less“significant social impact”.Therefore,it is essential to rethink the role of seven member collegiate panel,so that it can be available for the parties in criminal cases.As long as the parties apply for it,the court shall form a seven member collegiate panel in the trial.
