党政联合发文信息公开的困境及其成因探析——基于166个信息公开司法案例的质性分析

摘　　要：近年来党政联合发文数量急剧增加,其信息公开问题引发众多复议和诉讼等。公众面临着党政联合发文信息公开需求得不到满足的困境,而政府和法院存在着公众不信任、不认同和抗议“党政联合发文不予公开”的困境。借助166个与党政联合发文信息公开有关的司法案例,运用扎根理论的研究方法对公众起诉理由和证据逐句编码,结果表明:党政联合发文信息公开困境的形成原因在于党务信息公开链的断裂、党政联合发文属性的认知冲突、党政联合发文信息公开的实践冲突、救济权利的部分否定。该困境可尝试从法律规范、制度治理和增强共识三条路径加以突破。In recent years,there has been a rapid increase in the number of Party-Government joint documents,and the issue of information disclosure has caused many reviews and lawsuits.The public is faced with the dilemma that the demand for information disclosure in joint party-government documents cannot be met,while the government and courts have the dilemma of public distrust and disapproval and protest against the"non-disclosure of joint party-government documents".Based on the 166 judicial judgment documents which are related to Party-Government joint documents as the foundation,this paper analyzes the document types,statement characteristics and behavior characteristics in the content of the public application,and encodes the public prosecution reasons and evidence sentence by sentence with Grounded Theory Methodology.It is found that the formation of this dilemma mainly lies in the following aspects:the rupture of the Party information disclosure chain,the cognitive conflict of Party-Government joint documents,the practical conflict of Party-Government joint documents,and the partial denial of relief rights.This dilemma can be solved by means of three ways:legal norms,institutional governance and enhanced consensus.
