论大数据后疫情时代的隐私让渡

摘　　要：在大数据后疫情时代,隐私让渡呈现不断增长态势,存在侵犯隐私、侵蚀人性、瓦解社会等重大风险。隐私的内在特性为隐私让渡提供了可能基础,可分享性提供了让渡的客观基础,主客观综合性提供了让渡的主观基础,价值相对性提供了让渡的法权基础,而大数据技术与后疫情安全进一步激活并强化了隐私让渡的各种可能基础。能够为隐私让渡提供正当理由的,只能是与隐私价值相当或更高的其他重要价值。大数据技术与后疫情安全凸显了隐私让渡的三个正当理由:一是自我的其他正当权益,二是他人的基本正当权益,三是共同体的重要正当权益。面对各种现实压力和思想诱惑,只有在为何让渡隐私的问题上坚持正当性原则,在如何让渡隐私的问题上坚持自主性原则,在让渡多少隐私的问题上坚持最小化原则,在让渡何种权限的问题上坚持可控性原则,才能将隐私让渡限制在合理限度之内,真正实现个人隐私、科学技术与人类社会的协调发展。In the post-epidemic era of big data,the transfer of privacy presents a growing trend,and there are major risks such as invasion of privacy,erosion of humanity,and disintegration of society.The inherent characteristics of privacy provide the possible basis for privacy transfer,sharability provides the objective basis,subjective and objective comprehensiveness provides the subjective basis,and value relativity provides the legal basis,while big data technology and post-epidemic security further activate and strengthen various possible bases for the transfer.Only other important values equal to or higher than the privacy value can justify the transfer of privacy.Big data technology and post-epidemic security highlight three legitimate reasons for privacy transfer:the other legitimate rights and interests of the self,the basic legitimate rights and interests of others,and the important legitimate rights and interests of the community.In the face of various realistic pressures and ideological temptations,only by adhering to the principle of legitimacy on the issue of why to transfer privacy,the principle of autonomy on the issue of how to transfer privacy,the principle of minimization on the issue of how much privacy to transfer,and the principle of controllability on the issue of what authority to transfer,can we limit the transfer of privacy to a reasonable limit,and realize the coordinated development of personal privacy,science and technology and human society.
