摘　　要：民生权益可分为生存权和发展权两个层面。共享发展以人民为中心,强调均衡、兼容、公平与普惠,是中国式发展的出发点和落脚点,国家法治建设的重点之一就是着力解决民生发展中的社会公平正义问题,促进实现共同富裕。民生刑法有着尊重人格、关怀人性、保障人权的人本价值。在新时代发展中,民生刑法具有四个方面的价值维度:保障权利自由与维护秩序安全、维持公平正义与促进效率激励、弱者倾斜保护与兼顾利益平衡、倡导宽容人道与贯彻宽严相济。刑法应当对民生权益给予有力的保障和救济,把握民生侵权行为的入罪门槛。应当确立积极审慎的刑法观,防止刑法调控民生风险的过度化。基于包容性治理理念,民生领域刑事治理应当推动刑事立法民主化,构建多元化协商合作机制,完善软硬法结合的规范体系,实现民生刑事法治的中国式现代化。The rights and interests of people's livelihood can be divided into two levels:the right to subsistence and the right to development.Shared development focuses on the people and emphasizes balance,compatibility,fairness and inclusiveness,which is the starting point and foothold of Chinese style development.One of the key points of national rule of law construction is to focus on solving social fairness and justice issues in the development of people's livelihood and promote common prosperity.The people's livelihood criminal law has the humanistic value of respecting personality,caring for human nature and protecting human rights.In the development of the new era,the people's livelihood criminal law has four value dimensions:safeguarding freedom of rights and maintaining order and security,maintaining fairness and justice and promoting efficiency incentives,protecting the weak and balancing interests,advocating tolerance and humanity and implementing leniency and severity.The criminal law should give strong protection and relief to the rights and interests of the people's livelihood,and grasp the threshold of the infringement of the people's livelihood.We should establish a positive and prudent view of criminal law to prevent the excessive risk of criminal law regulating people's livelihood.Based on the concept of inclusive governance,criminal governance in the field of people's livelihood should promote the democratization of criminal legislation,build a diversified consultation and cooperation mechanism,improve the normative system combining soft and hard laws,and realize the Chinese path to modernization of people's livelihood criminal rule of law.
