摘　　要：刑事附带民事公益诉讼中调解的适用面临着规范缺位与实践运行失序的现实困境,亟须理论指导与制度因应。刑事附带民事公益诉讼中调解制度的适用具有全面维护社会公益的价值目标、检察机关妥当参与的职责担当、民事公益诉讼的本质属性与效率价值追求的规范符合性之正当性基础,具有提高诉讼效率、保障切实履行的必要性需求与客观事实调查、主观量刑激励的可行性支撑,故此,理应在规范层面明确肯定调解的适用。与此同时,为保障调解制度的规范运行与实施效果,仍需建立调解过程中的法院主导、检察角色的平等性区分、公告与公开程序的强化监督以及事实保障下的调解前置的有效措施。The application of mediation in public interest penal litigation with civil incidental is faced with the practical dilemma of the absence of norms and the disorder of practical operation and is in urgent need of theoretical guidance and system response.The application of the mediation system in public interest penal litigation with civil incidental has the value objective of comprehensively safeguarding social public interest,the duty of procuratorial organization to participate properly,the essential attribute of civil public interest litigation and the legitimate basis for the conformity of the norms of efficiency value pursuit,which has the necessity to improve the efficiency of litigation and ensure the effective implementation and the feasibility support of objective fact investigation and subjective sentencing incentive,therefore,the application of mediation should be clearly affirmed at the normative level.At the same time,in order to ensure the standardized operation and implementation effect of the mediation system,it is also necessary to establish effective measures such as court leadership in the mediation process,equal distinction of procuratorial roles,strengthened supervision of public announcement and procedure disclosure and pre-mediation under the guarantee of facts.
