网络异化型犯罪解释中指导性案例的应用研究

摘　　要：随着我国进入网络时代,社会结构和思维方式都发生了潜移默化的改变。传统犯罪的网络异化趋势明显。对于网络异化型犯罪,司法实践陷入彷徨,呈现体系性的争议。为了寻求现行刑法在网络异化型犯罪中的恰当运用,应发挥指导性案例的标杆性作用,使之引导网络异化型犯罪案件的办理,促进该类犯罪解释共识的形成。在相似性判断过程中,应遵循“寻找案件争议点—厘清关键性事实”的路径,以关键性事实为联结点比较待决案件与指导性案例。在提炼裁判逻辑与规则过程中,应兼顾具体性与概括性,在合理约束法官裁量权的同时,确保指导性案例的创新性运用。As China enters the era of the internet,social structure and way of thinking have undergone subtle changes.The trend of network alienation in traditional crimes is obvious.Regarding the alienation of network crime,judicial practice has fallen into confusion and presented systematic controversies.In order to seek the appropriate application of the current criminal law in network alienation crimes,the guiding role of guiding cases should be played,so as to guide the handling of network alienation crime cases and promote the formation of consensus on the interpretation of such crimes.In the process of similarity judgment,the path of"finding controversial points in the case-clarifying key facts"should be followed,and the key facts should be used as the connection point to compare the pending case with the guiding case.In the process of refining the judgment logic and rules,both specificity and generality should be taken into account,while reasonably constraining the judge's discretion and ensuring the innovative application of guiding cases.
