民事裁判结论逻辑正确的形式基础——浅论裁判文书形式的规范化

摘　　要：我国民事诉讼裁判文书整体质量比较高,但还存在部分裁判文书归纳争议焦点不准确、未全面反映当事人举证、脱离诉求与抗辩逻辑、事实重建不够谨严、对妨碍民事诉讼行为置之不理等问题;应当通过准确归纳争议焦点、全面反映当事人举证、事实重建逻辑谨严、判决书内容完整、对妨害民事诉讼行为予以处理等对策提高裁判文书整体质量。The overall quality of civil litigation judgment documents in our country is relatively high,but there are still some problems such as inaccurate summary of the focus of disputes in some judgment documents,incomplete reflection of the parties'evidence,detachment from the logic of claims and defenses,insufficient caution in factual reconstruction,and disregard for obstructing civil litigation behavior.We should improve the overall quality of the judgment documents by accurately summarizing the focus of disputes,comprehensively reflecting the evidence provided by the parties,reconstructing the logic of the facts with caution,completing the content of the judgment,and dealing with acts that hinder civil litigation.
