关于完善我国居住权制度的立法建议

摘　　要：居住权制度是《中华人民共和国民法典》中新增的法律制度,但目前的居住权制度不能根本解决司法实践中的相关问题。究其原因是规定居住权的法律条文太少,仅有六条法律条文搭建了居住权制度的基础框架,且过于粗放。完善居住权制度,需要从立法角度予以补充和完善,要突出居住权的用益物权属性;补充居住权权利人的主体范围;明确并完善居住权的多种设立方式、权利义务内容和消灭事由等方面的法律规范,从而根本解决居住权制度法条设定模糊、权利适用不足等问题。the residence right system is a new legal system in the Civil Code of the People's Republic of China,but the current residence right system cannot fundamentally solve the related problems in judicial practice.The reason is that there are only a few legal provisions on the right of residence.Only six legal provisions have built the basic framework of the residence right system,which is too extensive.This paper argues that the perfection of the residence right system needs to be supplemented and improved from the legislative point of view,to highlight the usufructuary right attribute of the residence right;to supplement the scope of the subject of the right holder;to clarify and perfect the legal norms of various establishment methods,rights and obligations,and elimination reasons of the residence right,so as to fundamentally solve the problems of vague legal provisions and insufficient application of rights in residence right system.
