摘　　要：检察公益诉讼制度全面实施至今,各地检察机关在食品安全领域不断探索提起惩罚性赔偿,取得较好效果。以C直辖市检察机关的司法实践为样本,分析食品安全民事公益诉讼惩罚性赔偿的法制沿革和必要性,发现目前还存在法律规定不够完善、证据准备面临难题、计算方法存在不足、管理制度不够健全等问题。立足于司法实践的需要,可以从完善立法规定、强化证据准备、细化计算标准、构建管理制度、规范赔偿使用等方面进行改进。The report of the 20th National Congress of the Communist Party of China proposed to strengthen food and drug safety supervision.Since the procuratorial public interest litigation system has been fully implemented,local procuratorial organs have been constantly exploring and filing punitive damages in the field of food safety,and some cases have won and achieved good results.On the premise of analyzing the legal evolution and necessity of punitive damages in food safety civil public interest litigation,and taking the judicial practice of the procuratorial organ of C City as an example,it can be found that there are still problems such as insufficient legal provisions,difficult problems in evidence preparation,insufficient calculation methods,and insufficient management system.Based on the needs of judicial practice,improvements can be made from the aspects of perfecting the legislative provisions,strengthening the preparation of evidence,improving the quality of litigation,refining the calculation standards,clarifying the basis of compensation,building a management system,and standardizing the use of compensation,so as to achieve the perfection and practical effect.
