摘　　要：作为实现权利的程序,民事执行程序的各个环节都要围绕权利实现这一目的来设计。但民事执行程序在法院内部不是孤立的,从时间顺序上看,它在立案、审判程序之后,中间还有信访、破产等程序。从法院内部的职能部门看,还有民事、刑事、行政等法律部门。它们之间的职能既有分工,也有交叉,还有配合衔接。无论是民事诉讼程序各阶段,还是各法律部门,其职权的配置、权力的运行都是为了输出优秀的司法作品,实现当事人的胜诉权益;等等。民事执行工作的外联性、开放性决定了做好民事执行工作离不开各协助执行部门的配合。在上述任何环节,都需要运用系统思维,综合考虑自身职能与案件执行效果之间的关联,在做好自身环节的基础上念念不忘全案的执行效果。同理,民事执行程序亦需要有更宽广的视野,充分运用系统思维,将民事执行工作融入国家治理体系和治理能力现代化之中。As a procedural means to realize rights,each step of the civil enforcement procedure should be designed with the aim of achieving rights realization.However,the civil enforcement procedure is not isolated within the court.In terms of chronological order,it follows the filing and trial procedures,with intermediate processes such as petitions and bankruptcy.Within the court's internal functional departments,there are also legal departments for civil,criminal,and administrative matters.Their functions are both specialized and overlapping,requiring coordination and cooperation.Whether it is the various stages of civil litigation procedures or the different legal departments,the allocation of powers and the operation of authority are all aimed at producing excellent judicial outcomes and ensuring the rights and interests of the parties.The external and open nature of civil enforcement determines that effective collaboration with various assisting enforcement agencies is essential.At any stage mentioned above,it is necessary to apply systems thinking,considering the interrelationship between one's own functions and the outcomes of case execution,and always keeping in mind the overall execution result while performing one's own role.Similarly,the civil enforcement procedure also requires a broader perspective and the full utilization of systems thinking,integrating civil enforcement into the modernization of the national governance system and capability.
