全过程人民民主视域下人民陪审员参与死刑案件审理研究

摘　　要：全过程人民民主对司法领域人民民主也提出了深刻要求,其中重要方面就是认真贯彻人民陪审制度。根据《人民陪审员法》规定,具有重大社会影响的死刑一审案件实行由4陪3审组成的7人制合议庭审理,但实际上,据调研,《人民陪审员法》生效前后的死刑案件中均有半数没有实行人民陪审,特别是在《人民陪审员法》实施4年来,没有一例死刑案件按照法律规定进行了7人制合议庭审理。可见,死刑案件的人民陪审是不合乎要求的。未来应当进一步修改立法,取消死刑案件人民陪审的社会影响重大限制性条件,实行死刑案件一律陪审。同时,要在死刑案件7人制合议庭审理中构建人民陪审员就事实和法律问题的同等表决权,确保全过程人民民主在死刑这一具有典型意义的案件中得到完整贯彻。The whole process of people’s democracy also put forward profound requirements for the people’s democracy in judicial field,among which the important aspect is to earnestly implement the people’s jury system.According to the provisions of the People’s Jurors Law,death penalty cases of first instance with significant social impact are tried by a seven-member collegiate panel consisting of four jurors and three judges.In fact,according to the research,half of the death penalty cases before and after the People’s Jurors Law took effect have not been tried by people’s jury.Especially in the four years since the People’s Jurors Law came into effect,no death penalty case has been tried by a seven-member collegiate panel as required by law.It can be seen that the people’s jury in death penalty cases does not meet the requirements.In the future,the law should be further amended,the restriction conditions of people’s jury trial in death penalty cases with significant social impact should be abolished,and all death penalty cases should be tried by jury.At the same time,it is necessary to construct equal voting rights of people’s jurors on facts and legal issues in the trial of death penalty cases with seven-member collegiate panel,so as to ensure that the whole process of people’s democracy is fully implemented in the case of death penalty with typical significance.
