劳动法视角下职业体育俱乐部劳动争议处理的现实审思与路径选择——基于387项司法审判案例的分析

摘　　要：职业体育俱乐部与职业运动员、教练员之间劳动关系的和谐稳定以及劳动争议的平稳处理是职业体育发展的前提与基础。运用判例研究的分析方法,对从裁判文书网中搜集到的387个(2015年-2022年)职业体育俱乐部劳动争议司法审判案例从劳动法视角进行案情分析、判旨分析与判决分析等系统考察。通过判例分析总结了当前职业体育俱乐部劳动争议处理过程中在劳动关系确认与特殊劳动关系认定、劳动权益保护条款适用、以及争议管辖权三方面的现实特征与困境。由此,提出了在劳动法与新《体育法》背景下,职业体育俱乐部劳动关系协调与劳动争议处理的路径选择,即明晰强化劳动关系确认、深化拓展劳动权益事项、建立健全“调解-仲裁-诉讼”的劳动争议处理机制、完善体育从业者劳动权益保障与劳动争议处理特殊规定。A harmonious and stable labour relationship between professional sports clubs and professional athletes and coaches,as well as the smooth handling of labour disputes,is the premise for the development of professional sports.Through the case analysis,jurisprudence analysis,and verdict analysis of 387 judicial cases(2015-2022)collected from the website of China Judgments Online,this study summarized three main characteristics and dilemmas in terms of the confirmation of labour relations and special labour relations,the application of labour rights protection clauses,and the issue of dispute jurisdiction in dealing with labour disputes in professional sports clubs.Based on these characteristics and dilemmas as well as from the perspective of labour law and the newly revised Sports Law,the study put forward suggestions for coordinating labour relations and settling labour disputes in professional sports clubs from the following aspects:the confirmation of clear labour relations,the expansion of labour rights and interests,the construction of“mediation-arbitration-litigation”dispute settlement mechanism,and optimizing special regulations on employment relations in the sports field.
