四十年来国内权利理论研究述评

摘　　要：对权利理论的关注是中国法学研究永恒的课题。从时间维度上看,改革开放以来我国法学界对权利理论的研究大体可分为三个时期:20世纪80年代、20世纪90年代、21世纪至今。每一时期国内学者对权利理论的研究各有其贡献及限度。梳理四十年来国内权利理论研究的历史,就是权利话语在中国从确立、发展到不断完善的历史。然而,四十年来的研究仍存在着不同程度上的“共时性”和“历时性”问题,如意识形态的非学术话语;受现代化权利理论的支配;权利证立规范性依据的缺失等。通过时间脉络梳理四十年来国内学者对权利理论的研究历史会发现:几十年来的权利理论研究并未形成一套基于中国法学自身具有解释力的、体系化的规范性权利理论,面对现实发生的诸多权利问题,学界对权利理论的体系性构建仍在逐步探索之中。The attention to rights theory is an eternal topic in Chinese legal research.From the temporal perspective,the research on rights theory in China's legal community since the reform and opening up can be roughly divided into three periods:the 1980s,the 1990s,and the 21st century to the present.In each period,domestic scholars have their own contributions and limitations to the study of rights theory.The history of domestic rights theory research over the past 40 years is the history of the establishment,development to continuous improvement of rights discourse in China.However,there are still varying degrees of"synchronic"and"diachronic"problems in research over the past 40 years,such as non-academic discourse in the form of consciousness;dominated by the theory of modern rights;the lack of normative basis for establishing rights.Through a chronological review of the research history of right theory by domestic scholars over the past forty years,it can be found that the research on rights theory over the past few decades has not formed a set of interpretive and systematic normative rights theories based on Chinese law itself.In the face of many rights problems that have occurred in reality,the academic community is still gradually exploring the systematic construction of rights theory.
