摘 要:海事调查结论不再适用行政复议和行政诉讼,使得这一行政救济制度丧失了对于海事调查结论缺陷的纠正功能。在此背景下,需要结合海事调查实践,运用行政救济制度理论,并参照法律规定的行政救济制度,完善现行海事调查结论缺陷防范与纠正机制、创设新的机制并保证其运行,以保障海事调查结论的科学性和公信力,充分发挥海事调查的功效。海事调查结论缺陷防范机制包括专家论证、科学运用证据和准听证,海事调查结论缺陷纠正机制包括行政复核、信访处理和重新调查。这种机制应当在全国范围内实现制度化、常态化。The maritime accident investigation conclusions are not subject to administrative reconsideration and administrative litigation any more,which results in the loss of functions of these administrative relief regimes in correcting potential defects in the investigation conclusions.Under this background,for the purpose of ensuring the scientificity and credibility of investigation and and giving full play to its functions,it is necessary to improve the existing defect prevention or correction mechanisms and to create new mechanisms taking into consideration the investigation practice,based on the application of administrative relief theories and the reference to the statutory provisions of administrative reliefs.The defect prevention mechanisms may include expert review,scientific application of evidence and quasi-hearing,and the defect correction mechanisms may include administrative review,complaint handling and reinvestigation.These mechanisms need be institutionalized and normalized nationwide.
