帮助信息网络犯罪活动罪的入罪限制  

On the limits of criminalization for the crime of aiding information network criminal activities

摘　　要：近两三年来,帮助信息网络犯罪活动罪的数量出现大幅度上升的趋势,有口袋化之嫌。本罪的规范属性是帮助行为正犯化,该帮助行为确具有独立性,但是只承认独立性容易滥用该罪名,从属性是帮助行为固有的属性,对本罪的研究不可忽视该属性。以帮助行为的从属性为出发点对本罪的构成要件进行合理解释,该帮助行为不包括间接帮助和主观模糊的中立帮助行为。明知的时间节点,在帮助对象着手实施犯罪之后,实行行为结束之前成立,谨慎适用明知的推定,禁止根据推定的事实进行再次推定,允许提出合理怀疑。同时,遵循情节严重双重限制的标准,贯彻情节严重限制入罪的机能。In the past two to three years,the number of crimes of helping information network criminal activities has shown a sharp upward trend,and it is suspected of pocketing.This crime belongs to the criminalization of the act of aid,and the act of helping is indeed independent,but only recognizing independence is easy to abuse the crime,and the subordinate attribute is an inherent attribute of the act of help,and the study of this crime cannot ignore this attribute.The constituent elements of this crime are reasonably explained from the subordinate nature of the act of help,and the act of assistance does not include indirect assistance and subjective ambiguity of neutral assistance.Knowing the time point is established after the target is helped to proceed to commit the crime and before the end of the act,the presumption of knowledge is carefully applied,the resumption based on the presumptive facts is prohibited,and reasonable doubt is allowed.At the same time,follow the standard of double limitation of serious circumstances,and implement the function of serious restrictions on criminalization.
