摘　　要：近年来,随着粤港澳三地交往日趋频繁,跨境犯罪也日益猖獗,通过区际刑事司法互助来增强对跨境犯罪的打击力度已成为必要手段。但实践证明,当前刑事司法互助调查取证仍存在诸多困境,主要体现在粤港澳三地法律制度存在差异、证据适用差异化大、情报信息合作滞后等方面。因此,应协调内地与港澳地区法律制度存在的差异、规范内地与港澳地区刑事司法互助调查取证的法律程序、构建内地与港澳地区犯罪情报信息共享机制,从而构建打击粤港澳大湾区跨境犯罪的刑事司法互助调查取证机制,深化粤港澳大湾区刑事司法互助水平,提高共同打击犯罪的能力。In recent years,with the increasingly frequent exchanges between Guangdong,Hong Kong and Macao,cross-border crimes have become increasingly rampant,and it has become necessary to strengthen the fight against cross-border crimes through inter-regional criminal judicial assistance.However,practice has proved that there are still many difficulties in the investigation and collection of criminal mutual judicial assistance,which are mainly reflected in the differences in the legal systems of Guangdong,Hong Kong and Macao,the great difference in the application of evidence,and the lagging cooperation in intelligence and information.Therefore,we should coordinate the differences between the legal systems of the Mainland and Hong Kong and Macao,standardize the legal procedures for investigation and evidence collection of mutual legal assistance in criminal matters between the Mainland and Hong Kong and Macao,and establish a mechanism for sharing criminal intelligence and information between the Mainland and Hong Kong and Macao,so as to establish a mechanism for investigation and evidence collection of mutual legal assistance in criminal matters to combat cross-border crimes in the Greater Bay Area,and deepen the level of mutual legal assistance in criminal matters in the Greater Bay Area.Enhance the ability to jointly fight crime.
