侦查人员书面证言的运用规则研究

摘　　要：在刑事诉讼中,侦查人员书面证言在案件实体和程序事实认定方面大量使用,发挥着重要作用。为规范侦查人员书面证言的制作与运用,保障侦查人员出庭率较低背景下的实质真实发现,通过对侦查人员书面证言的实践现状和法律规范进行实证考察,发现因立法和司法解释仅对侦查人员书面证言作了有限规范,其书面证言存在着证据制作混乱、证据规则缺位等问题。建议针对侦查人员书面证言的自身特点,通过规制其形式与内容要件、确立例外规则、限制其使用范围和规范其审查认定等,确立侦查人员书面证言运用的合理路径。At present,remoted and isolated petrochemical enterprises,energy reserve bases,key infrastructure and other key locations still face significant threats of terrorism attacks.According to the technical method of"scenario task capability"of emergency management,Delphi method,an evaluation system of capabilities of emergent responses to terrorist attacks in high-risk suburban places is constructed.A petrochemical enterprise is taken as the evaluation object to carry out the evaluation application and to draw the evaluation conclusion.Based on the evaluation conclusion,it is proposed to strengthen technical preventions in high-risk locations and enhance capabilities of self-prevention and self-rescue.It is necessary to strengthen the construction of new types of police reception and handling,and enhance the ability to arrive quickly and the construction of professional teams,to enhance on-site disposal capabilities,to construct the contingency plan mechanisms,and to improve the ability of linkage and collaboration.The evaluation results obtained have been valued by relevant government functional departments and relevant enterprises,and the evaluation indicator system and methods are strongly operable.
