摘　　要：中国涉海问题的法理维权应当全方位展开,在国际法、海洋法等手段以外刑法的作用不容忽视,刑法维权首当其冲的是海洋刑事管辖权问题。但我国现行刑事管辖权在应对海洋权益的多重挑战下凸显不适。鉴于海洋刑事管辖权与主权的相连性,且极具特殊性,必须对其进行适应性的理论建构。海洋刑事管辖权的创设具有学理与研究范式的独立价值,它涉及多学科的融合与交叉,既有广义的指称,又有狭义的指称,包含立法管辖权与司法管辖权两项内容;国际刑事管辖权与国内刑事管辖权两个维度。在我国海洋刑事管辖权面临多重现实挑战的背景下,应做好充分的理论准备,在立法上确认、完善,在司法上践行海洋刑事管辖权,探索海洋刑事管辖权理论体系,从而实现刑法维权的目的。The legal rights protection of China's maritime related issues should be carried out in an all-round way.Criminal law other than international law and the law of the maritime cannot be ignored.The first consideration of criminal law rights protection is the issue of maritime criminal jurisdiction.However,China's current criminal jurisdiction is not suitable for dealing with the multiple challenges of maritime rights and interests.In view of the connection and particularity of maritime criminal jurisdiction and sovereignty,it is necessary to construct an adaptive theory.The creation of marine criminal jurisdiction has the independent value of academic theory and research paradigm,which involves the integration and intersection of multiple disciplines,including both broad and narrow referents,including legislative jurisdiction and jurisdiction.There are two dimensions of international criminal jurisdiction and domestic criminal jurisdiction.China's maritime criminal jurisdiction is facing multiple practical challenges,and it should make full theoretical preparations,confirm and improve it in legislation,practice maritime criminal jurisdiction in judicial terms,and explore theoretical systems,so as to achieve the purpose of criminal law rights protection.
