摘 要:在行政诉讼已成行政公益诉讼与行政私益诉讼双重结构的情况下,需要特别注意区分两者,结合行政公益诉讼自身的特质进行制度设计。通过实证分析,可以发现目前行政公益诉讼裁判制度表现出立法上排除给付判决,实践中判决类型集中等不同于行政私益诉讼的特点。在具体规则层面,存在履行判决构成要件不够明晰,确认违法判决适用不合理,过度解读公共利益限制原告资格的问题。需要从司法经验中提取履行判决构成要件的判断体系,对与确认违法判决关联的制度设计进行改造,肯定公益与私益相融合案件的可诉性,以促进行政公益诉讼制度效能的实现。In the case that administrative litigation has become a dual structure of administrative public interest litigation and administrative private interest litigation,special attention should be paid to distinguishing between the two,and the system needs to be designed according to the characteristics of administrative public interest litigation itself.Through the empirical analysis,it can be found that the current administrative public interest litigation judgment system shows the characteristics of excluding payment judgment in legislation and concentrating judgment types in practice,which are different from administrative private interest litigation.At the level of specific rules,there are some problems,such as ambiguity of the constituent elements of the execution of the judgment,unreasonable application of the illegal judgment,and excessive interpretation of public interests to restrict the qualification of the plaintiff.It is necessary to extract a judgment system for the components of fulfilling judgments from judicial experience,reform the system design related to confirming illegal judgments,and affirm the litigation feasibility of cases that integrate public and private interests,so as to promote the effectiveness of the administrative public interest litigation system.
