基于同伴效应的罪犯改造教育机制研究

摘　　要：我国犯罪率较几十年前有明显升高,同时监狱改造活动消耗大量社会资源,论文从行为经济学角度出发研究监狱内罪犯间的同伴效应,并尝试分析监狱改造的效果产生机制。运用中国中部某低安全等级监狱某监区6个月监狱内关押所有罪犯的改造成绩记录及其人口特征数据研究发现:互监小组内和生产线内的罪犯之间存在显著的同伴效应,罪犯行为具有较明显的正向外部性;控制变量方面,年龄与监狱改造表现呈显著负相关关系,互监组组长能对罪犯改造起到较明显的正向促进作用;此外服刑期相较于总刑期越长,罪犯改造效果越差,或许背后有更多的社会动机,有待进一步探究。最后提出针对性的政策建议,认为监狱管理人员可以灵活及时地更换组内、生产线内成员,使改造优秀的罪犯多帮助引领新入狱罪犯、改造表现稍差罪犯,提升整体监狱管理水平;尝试对不同年龄段的罪犯实施不同的考核办法,如提升教育改造权重,使罪犯降低对生产改造的注重程度,转为更加重视思想改造。The crime rate in China has grown higher than that of a few decades ago,and reform and educational activities in prison consume a lot of social resources.The paper reseach the peer effect among criminals based on the behavioral economics,and tries to analyze the The impact of reform and educational mechanism for criminal.The study uses the data,which consist of score of reform and educational and demographic characteristics of all criminals in prison.The prison which is located in central area of China is a low-security prison.The results show that there exsit a significant positive peer effect among the criminals in one supervision group.And a significant positive peer effect also exsits among criminals in the same production line.This indicates there are obvious positive externalities among criminals.In terms of control variables,age and prison performance are significantly negatively correlated,and the leaders of supervision team can play a more obvious positive role in promoting the performance of his group members.In addition,the longer time criminals stays in prison,the worse they performs,perhaps there are more social motives behind this phenomenon which need to be further explored.Finally,the paper thinks that prison managers flexibly exchange supervision group and production line members,so that outstanding criminals can help and lead new fellows or criminals with poor performance,and improve the prison management.Try Different assessment methods that are implemented on criminals of different ages,for example increasing the weight of score of educational performance,so that criminals will lessen their emphasis on production reforms and pay more attention to ideological reforms.
