摘  要:食品安全关乎社会公共利益,近年来食品安全事件频发,食品召回制度因其快速、精准等特点成为食品生产经营管理的主要手段。为推进企业主动召回不安全食品,《食品安全法》和《食品召回管理办法》分别对食品召回作出了原则指引和具体规定。本文以食品安全风险为切入点,从法律和学理两个角度对食品召回责任进行探讨,结合其经济法属性,重构食品召回责任“主体-风险-法律责任”新模式,并从法律和实践两个层面提出建议,以期促进食品召回制度的实施,预防食品安全风险。Food safety is closely related to public welfare.With the frequent occurrence of food safety incidents in recent years,the food recall system has become a main tool for food production and management due to its speed and precision.To promote the voluntary recall of unsafe food by enterprises,the Food Safety Law and the Food Recall Management Measures have outlined guiding principles and specific provisions for food recall,respectively.This article takes food safety risks as the entry point,and discusses he food recall responsibilities from both legal and theoretical perspectives.Integrating its economic law attribute,it reconstructs a new model of"subject-risk-legal responsibility"for food recall responsibilities.The article puts forward suggestions from legal and practical standpoints to promote the implementation of food recall system and prevent food safety risks.
