摘　　要：监察体制改革后,我国刑事案件的职能管辖制度发生了改变,实践中产生了监察机关与公安机关关联案件职能管辖冲突问题。现有规范及实践以“监察为主调查”管辖原则及“实体判断+听取意见”的模式对监察机关与公安机关关联案件职能管辖冲突进行规制,导致监察实践中价值冲突日益显露,越权管辖出现证据能力遭受质疑、被追诉人的权利难以保障等问题。进入深化国家监察体制改革阶段,监察机关与公安机关关联案件职能管辖冲突的规制需要在吸收多元考量因素的基础上,构建以监察机关为主的专案组调(侦)查模式,并赋予被追诉人管辖异议权,在值班律师的帮助下保障其基本权利。未来,在中国式法治现代化的推进过程中,要进一步规范办案机关的职能管辖裁量权,同时对“恶意管辖”进行程序性制裁,进而推动职能管辖制度的法治化。The functional jurisdiction system of criminal cases in China has changed since the reform of the supervision system.In practice,the problem of jurisdiction conflict on cases connected between the supervision organ and the public security organ has arisen.Existing norms and practices govern the jurisdiction principle of“supervision-oriented investigation”and the mode of“entity judgment+listening to opinions”.It leads to an increasingly exposed value conflict in supervision practice,the concerns of evidence ability due to ultra vires jurisdiction,and difficulty in protecting rights of the accused.As the national supervision system reform progresses,the regulation of the judicial conflict between the connected cases between the supervision organ and the public security organ must build a special investigation mode with the supervision organ as the main part.It should also give the accused the right to dissent and protect their basic rights with the assistance of the lawyer on duty.In the future,as China's rule of law modernizes,it will be necessary to further standardize the discretion of functional jurisdiction of case-handling organs and impose procedural sanctions on“malicious jurisdiction”to promote the legalization of functional jurisdiction system.
