摘　　要：认罪认罚从宽制度是中国特色社会主义刑事司法制度的重大创新,对完善我国刑事诉讼制度、提高司法效率以及推进国家治理体系和治理能力现代化具有重要意义。在制度全面推进的过程中,诉辩职能的发挥直接关系认罪认罚的正当性,并对制度诉讼效率和司法公正价值的实现产生重大影响。但实践中,认罪认罚案件的办理仍存在检察官自由裁量权不当适用、律师有效辩护实现困难、被追诉人自愿性保障不足等问题。从类似的辩诉交易比较法经验借鉴可知,有必要从辩诉职业伦理角度切入,构建我国认罪认罚从宽制度诉辩伦理规范,通过检察裁量权规范、司法诚信理念建构、有效辩护实质化等途径,保证诉辩职能发挥的规范化与合理化,促进认罪认罚从宽制度之完善。The plea leniency system is a major innovation of the criminal justice system of Socialism with Chinese characteristics,which is of great significance to improve China's criminal procedure system,enhance judicial efficiency,and promote the modernization of the national governance system and capacity.In the process of comprehensive promotion of the system,the function of prosecution and defense is directly related to the legitimacy of confession and punishment,and has a significant impact on the efficiency of litigation and the realization of the judicial fairness value in the system.However,in practice,there are still problems in handling cases of confession and punishment,such as improper application of prosecutor's discretion,difficulties in achieving effective defense by lawyers,and insufficient voluntary protection for the accused.From the experience of similar plea bargaining comparative law,we can see that it is necessary to start from the perspective of plea professional ethics to build the plea ethical norms of the leniency system of pleading guilty,and ensure the standardization and rationalization of the function of the plea through the norms of procuratorial discretion,the construction of the concept of judicial integrity,and the materialization of effective defense,so as to promote the improvement of the leniency system of pleading guilty.
