摘　　要：我国刑事庭前会议制度的发展脉络大致分为三个阶段:夯实前提与基础阶段(1979-2011)、正式确立与初步完善阶段(2012-2014)及改革与精细化发展阶段(2015至今)。其在扫除庭审障碍、提高诉讼效率、促进程序公正、保障诉讼权利、推动庭审实质化和提高审判质量等方面发挥着不可替代的作用。检视当下,刑事庭前会议制度运行存在着司法实践适用率偏低、非法证据排除争议较大和庭前会议庭审化风险三个突出难点。展望未来,破解难点需要完善外部保障和突破内部限制的共同发力,从客观看待适用率,明确庭前会议效力,重塑刑事证据审查结构,全面排除非法证据,科学配置诉讼资源和设立独立预审法官等方面予以完善。The development process of the criminal pretrial conference system in China can be roughly divided into three stages:the stage of consolidating the premise and foundation(1979-2011),the stage of formal establishment and initial improvement(2012-2014),and the stage of reform and refinement(from 2015 to present).It plays an irreplaceable role in removing obstacles in court trials,improving litigation efficiency,promoting procedural justice,safeguarding litigation rights,promoting the substantiation of court trials,and improving the quality of trials.At present,there are three outstanding problems in the operation of the criminal pretrial conference system,namely,the low application rate of judicial practice,the large dispute over the exclusion of illegal evidence,and the risk of pretrial conference being a trial.In the future,we should work together to improve external guarantees and break through internal restrictions.We should objectively view the application rate,clarify the effectiveness of pretrial conferences,reshape the structure of criminal evidence review,comprehensively eliminate illegal evidence,scientifically allocate litigation resources,and set up independent pretrial judges.
