摘 要:保护规范理论作为裁判相关人公权利的准据,一经引入就被我国司法实务迅速接受,以期塑造扩张型权利保障的行政诉讼新秩序。公法规范鲜有公权利的直接表达,惯以显性语言表达客观法文义,以隐性目的决定权利保护射程。我国法院倚重客观法内容叙述国家与个人的法律关系,难以妥当辨析出显性文义与隐性目的之关联以探明隐晦其中的公权利。这一形式解释偏好溢出了法解释本身,有必要在国家治理现实和法教义学的双重约束下,重新阐明保护规范理论实质解释的权利保护要义。As a basis to judge the Subjective Public Right,the theory of protection norms has been quickly accepted by China's judicial practice once it is introduced,in order to shape the new order of ad⁃ministrative litigation in the protection of expanding rights.There are few direct expressions of public rights in public law,but the meaning of objective legal text is always expressed in explicit language and the range of rights protection is determined by implicit purpose.Chinese courts rely heavily on objective law content to narrate the legal relationship between state and individual,so it is difficult to distinguish the relationship between explicit meaning and implicit purpose properly in order to probe into the hidden public rights.This preference for formal interpretation overflows the interpretation of law itself,and it is necessary to reclarify the right protection essentials substantively interpreted by protection norms theory under the dual constraints of national governance reality and legal doctrine.
