摘 要:专项治理已成为公安司法机关应对刑事司法领域紧迫问题的常用机制,一些重大的刑事司法改革也常带有鲜明的专项治理特征。这与专项治理不断增强的手段合法性、公安司法机关的社会治理功能、结果导向的刑事司法理念、我国的政法传统等密切相关。在“全面推进依法治国”的战略框架下,刑事司法领域专项治理的开展面临着诸多限制,但专门机关依然在一定程度上表现了对于专项治理的偏好。从组织合法性的角度看,专项治理的发起可以理解为相关主体在面对常规刑事司法积累的突出问题时对利益相关者群体评价压力的一种能动回应,而对压力类型的不同偏好决定了各参与主体的不同行动逻辑。只有在理念、制度、机制等方面做好衔接设计,才可能突破专项治理的常态化悖论,形成专项治理与常规治理有机协同的长效治理模式。Campaign-style governance has become a common mechanism for criminal judicial organs to deal with urgent problems in the field of criminal justice,and some major criminal justice reforms often have distinctive characteristics of campaign-style governance.This is closely related to the growing legitimacy of governance campaigns,the social governance function of criminal judicial organs,the idea of criminal procedure paying great attention to results,and the political and legal tradition of people s judicature.Under the strategic framework of“comprehensively promoting the rule of law”,campaign-style governance in the field of criminal justice faces many restrictions.However,specialized agencies still show a preference for campaign-style governance to a certain extent.From the perspective of organizational legitimacy,the launching of campaign-style governance can be understood as a dynamic response of relevant subjects to the evaluation pressure of stakeholder groups when facing the outstanding problems in criminal justice,and the different emphasis on the type of pressure determines the different action logic of each participant.As long as we have designed a perfect connection mechanism,we can completely break through the paradox of normalization of unconventional governance,and form a long-term governance model of organic coordination between campaign-style governance and conventional governance for specific problems.
