行政诉讼中确认违法和确认无效判决的理解与适用

摘　　要：从《行政诉讼法》及其《解释》的规定来看,确认违法和确认无效判决有其各自的适用情形。在司法审判实践中,由于法律规定的原则性以及个案的复杂性,适用何种判决形式而发生争议的情况时有发生。确认违法判决和确认无效判决都是对行政行为效力的否定,且其确认标准又带有一定的主观性,因而在适用时应极为慎重,应当综合考虑当事人的诉讼请求、法定无效的情形、判决的法律效果和社会效果等多种因素。According to the provisions of the Administrative Litigation Law and its Interpretation,conforma⁃tion of illegal and invalid judgments have their own applicable situations.In the judicial trial practice,due to the principle nature of the law and the complexity of individual cases,disputes about the applica⁃ble form of judgment happen on occasion.The confirmation of illegal and invalid judgments both deny the validity of administrative acts,and their conformation standards are also with certain subjectivity.There⁃fore,in the application of these judgments,it should be extremely cautious and should consider various fac⁃tors such as the parties’litigation requests,the legally invalid situations of judgments,the legal and social effects of judgments,to make a proper decision.
