摘　　要：随着生成式人工智能技术的迅猛发展,民事诉讼程序和非诉讼纠纷解决程序均已迈入数字化发展模式,但二者的公共服务功能供给不足,与当前基层社会治理需求不匹配,亟待从民事“诉非融合”协同创新和底层逻辑重构的双重维度寻求解决之道。在数字化协同创新方面,需进一步完善民事诉讼程序和非诉讼纠纷解决程序的衔接与融合,强化人工智能技术在多元化纠纷解决程序中的应用;在底层逻辑重构方面,应全方位融合民事诉讼程序与非诉讼程序,进行“一体化”制度融合,进而全面完善预防性法律制度,提升民事“诉非融合”型“诉源治理”水平和能力,有效防范和控制社会风险,破解基层社会治理矛盾纠纷妥善化解难题,促进中国式现代化民事“诉非融合”社会治理体系完善和社会治理效能整体提升。With the rapid development of generative artificial intelligence technology,civil litigation procedures and non-litigation dispute resolution procedures have entered the digital mode,but the tension between the insufficient supply of public service functions and the current mismatch between the current grassroots social governance requirement has become increasingly prominent.It is urgent to solve the problem from the dual dimensions of “litigation and non-litigation convergence” collaborative innovation and underlying logic reconstruction.In terms of digital collaborative innovation,we should further improve the connection and integration between civil litigation procedures and non-litigation dispute resolution procedures and strengthen the application of artificial intelligence technology in diversified dispute resolution procedures.In terms of underlying logic reconstruction,civil litigation procedures and non-litigation procedures are integrated in an all-round way,and the integrated system is isomorphic to comprehensively improve the preventive legal system,improve the level and ability of “litigation source governance” of “litigation and non-litigation convergence”,effectively prevent and control social risks,solve social conflicts and disputes,properly resolve problems,and promote the improvement of the Chinese-style modern “litigation and non-litigation convergence” social governance system and the overall improvement of social governance efficiency.
