中国内地与香港地区海事诉讼保全措施司法协助的先行问题解析

摘　　要：随着中国内地与香港特别行政区之间在仲裁领域达成并实施了全方位司法合作机制,两地间区域法律合作框架正向诉讼领域全方位合作迈进,实现覆盖诉讼程序中保全(或临时)措施的双边协助是最为艰难的一步,应当在海事诉讼领域率先推进。本文聚焦于两地在海事领域达成具有高效性和创新性保全(或临时)措施司法协助机制的先决问题研究,即准确认知因海事法律体系差异所导致的司法协助过程中的制度性障碍,从而具体设计出消除此类障碍的可行方案。构建两地海事诉讼保全(或临时)措施司法协助机制是我国当前较为迫切的司法工作,其司法目标在我国国家发展和法治建设的语境下才能得以确立。本文解析了制定具体协助规则的四个先行核心问题,即衔接海事管辖权、划定海事请求权范围、识别海事保全(或临时)措施以及重塑相关的司法审查标准,并提出我国加快建设国际(区域)司法合作能力的方向及内容。Having encompassed an all-inclusive mechanism for judicial cooperation in arbitration between China's mainland and Hong Kong region,the regional legal framework is now taking the last and most rigorous step towards an all-inclusive mechanism for judicial cooperation in litigation,that is,mutual assistance with interim measures in aid of court proceedings,and is enlisting a pilot device in the admiralty arena.The study in the article examines into what is believed to be a prerequisite for an eficient and innovative Admiralty Device:the postulations of the perceived institutional barriers to a feasible cooperation as well as the approaches available to remove the same.The analysis starts by contextualizing the judicial imperative with a view to crystallizing its judicial objectives.Four main issues that should precede the devising of specific legal instruments are elaborated,including the reconciliation of admiralty jurisdiction,the delimitation of maritime claims,the identification of interim measures,and the revamping of standards of review in granting or enforcing interim measures.Concluding remarks are presented on the essential aspects of China's judicial capability as is anticipated by a giant leap forward in legal cooperation.
