摘  要:科研信用规制作为一种兼具道德寓意与法治思维且游走于公私两域的治理模式,本质上是一种责任之治,其目的在于预防科技资源配置风险而非法律惩戒。我国科研治理沿袭由权力本位向权利本位再到责任本位的发展历程。当前的科研信用规制以公权力为主导,重视制度理性建构而忽视科研责任的承担与科研人员利益诉求、客观能力、价值观念等人性因素。科研信用规制法治化应以最优化科研责任承担为旨趣,合理界定德性培育与制度理性、行政权力与专业权力的作用场域,并通过重塑科研人员的主体性、厘定科研失信行为界限、优化科研失信责任等规则设计,实现由传统的“物本”性向“人本”性转变,最终迈向更加凸显主体性的公私法融合的科研治理新范式。In the premise of trust,academic integrity management is a scientific research management model that combines ethics and the rule of law,and absorb the nature of public and private sphere.In essence,it is an accountability management.In China,the management of scientific research projects has experienced a developing process from the standard of power to the standard of right,and now tends to responsibility standard.The current academic integrity management is dominated by the standard of power and emphasizes the systematic rationality,while ignoring human factors such as scientific research responsibility,interest appeals of researchers,objective abilities and values.Therefore,for stepping up the academic integrity management,it should firstly take aim at optimizing the use of responsibility standard,and transform the idea from“material orientation”to“human orientation”.We should reshape the corresponding implementation mechanism,including emphasizing the status of researchers,clarifying the scope of academic misconduct,improving credit management procedure and punishment mechanism.For this purpose,we should accept a new paradigm that highlights the subjectivity of researchers to a greater degree.
