摘　　要：环境问题和环境法的空间错位是环境法中的难题。这种空间错位是环境问题所处的事实空间与环境法效力的规范空间存在偏差所导致的,其本质系地理单元上自然规律与人的意志之争。为了消解这种空间错位,环境立法需要适应自然规律,环境法的“地理跃迁”应运而生。法哲学、法学范式和法律价值的演进为环境法的“地理跃迁”提供了合理性依据。法哲学正在经历从“以人为中心”到“人与自然和谐共生”的转变,法学范式正在从对策法学范式转向以“适应自然规律”和“整体系统观”为核心的新范式,法律价值也在从工业文明理念迈向生态文明理念。在立法技术上,空间正义、尺度和边界是环境法“地理跃迁”的独特范畴,相应地,空间正义原则、大尺度原则和边界有限原则成为立法时应考虑的重要原则。The spatial mismatch between environmental issues and environmental law is a major challenge in environmental law.It is a mismatch between the factual space in which environmental issues are located and the normative space of environmental law effectiveness.Its essence is the struggle between natural laws and human will in geographical units.In order to eliminate this spatial mismatch,environmental legislation needs to adapt to natural laws,and the“geographical leap”of environmental law has emerged.At present,the philosophy of law is undergoing a transformation from“people-centered”to“harmonious coexistence between humans and nature”.The legal paradigm is shifting from the countermeasure legal paradigm to a new paradigm being centered on“adapting to natural laws”and“holistic system view”.The legal value is moving from the concept of industrial civilization to that of ecological civilization.The evolution of the three provides a reasonable basis for the“geographical leap”of environmental law.In terms of specific legislative techniques,spatial justice,scale,and boundary are the unique legislative categories of environmental law's“geographical transition”.Correspondingly,the principles of spatial justice,large-scale principle,and boundary limitation become legislative principles.
