纪检监察一级学科对监察法规的属性厘清与功能拓展——以《中华人民共和国监察法实施条例》为分析视角

摘　　要：从纪检监察一级学科视域对党内法规与国家法律、纪检与监察的关系进行全新解读,有助于进一步厘清监察法规的属性并拓展其作为反腐败法规范的专属功能。从属性厘清的角度来看,纪检监察一级学科在学科基本属性、核心理念和基础范畴三个层面分别对监察法规的性质进行了学理补强,回应了其可能兼具的党内法规属性。从功能拓展的角度来看,纪检监察一级学科为监察法规的制定与实施提供了更前瞻性的理念指引、更针对性的制度保障和更专属性的人才支撑,优化了监察法规作为反腐败法规范的独特功能。对监察法规的属性与功能的拓展认知,有助于推动构建更加完善的监察法规体系。准确把握纪检监察学科建设与监察法规体系完善之间的关系,是持续深化纪检监察体制改革的内在要求。A deeper interpretation of the relationship between the intraparty rules and regulations and the state laws from the perspective of the first-level discipline of discipline inspection and supervision further clarifies the attributes of supervision laws and regulations and expands their special functions of anti-corruption.From the perspective of attribute clarification,the first-level discipline of discipline inspection and supervision has theoretically reinforced the nature of supervision regulations at the three levels of the basic attributes,core concepts and basic categories of the discipline,and responded to its possible attributes of intraparty regulations.From the perspective of function expansion,the first-level discipline of discipline inspection and supervision provides more advanced conceptual guidance,more solid institutional support and more professional talent guarantee for the formulation and implementation of supervision laws and regulations,and optimizes the function of supervision laws and regulations as the exclusive use of anti-corruption laws and regulations.The expanded cognition of the attributes and functions of supervision laws and regulations will help to promote the construction of a more complete supervision laws and regulations system.Accurately grasping the relationship between the discipline construction of discipline inspection and supervision and the improvement of the supervision and regulation system is the inherent requirement of continuously deepening the reform of the discipline inspection and supervision system.
