摘 要:作为定案依据的行政认定在刑事审判中被广泛使用,但在现行行刑衔接制度和刑事证据制度的框架下,无法将其归入到现有证据种类之中,也无法适用现有的证据审查规则。行政认定纳入刑事审判领域目前有三条可选路径,即归入现有某项证据种类之中、单列为第九大证据种类、在不归类的情况下直接适用证据规则。若以稳定性与适应性的二元价值体系为评价标准,应当将行政认定归入刑事诉讼鉴定意见作为最优路径选择,进而制定行政机关作出证据的行刑衔接规范,完善现行行刑衔接制度。Administrative identification is widely used in criminal trials as a basis for verdict,but under the framework of the current referral of administrative execution to criminal procedure system and criminal evidence system,it cannot be classified into the existing evidence types.Nor can it be applied to the existing evidence review rules.At present,there are three alternative paths for administrative identification to be incorporated into the field of criminal trial:to be included in a certain type of evidence;to be listed as the ninth type of evidence;and to be directly applied to the rules of evidence without classification.If the dual value system of stability and adaptability is taken as the evaluation standard,the best path selection should be made to classify administrative identification into appraisal opinion and then to improve the current system of referral of administrative execution to criminal procedure by adding the rules for evidence produced by the administrative organ.
