应构建民事诉讼律师费败诉方负担制度

摘　　要：律师费用的负担影响着各方当事人的诉讼行为,关系到最终司法价值的实现。目前国外律师费用负担模式主要分为当事人各自负担模式、败诉方负担模式以及例外模式。我国的律师费支付方式是完全由委托人自行负担律师费用。建立由败诉方承担律师费的制度,既能降低维权成本,又能促使当事人积极通过诉讼维护自身的合法权益,同时可以有效地遏制无理诉讼、虚假诉讼、恶意诉讼,提高律师的整体服务质量,增强公民的法治观念。The burden of attorney fees affects the litigation behavior of all parties and relates to the realization of the ultimate judicial value.At present,the burden mode of lawyer's fees in foreign countries is mainly divided into the respective burden mode of the parties,the burden mode of the losing party and the exception mode.The way of payment of lawyer's fees in China is that the client shall bear the lawyer's fees entirely.The establishment of a system in which the losing party bears the lawyer's fee can not only reduce the cost of rights protection,but also urge the parties to actively safeguard their legitimate rights and interests through litigation,ffectively curb unreasona-ble litigation,false litigation and malicious litigation,improve the overall service quality of lawyers and enhance citizens’concept of the rule of law.
