摘 要:《海上交通安全法》等国内法律规范均规定了“中国籍船舶”的权利义务,但是“中国籍船舶”的界定却存在一定争议,尤其是国籍证书过期的船舶是否还具有中国国籍。现行国内海事行政法律体系中,“中国籍船舶”的内涵从属于法律规范,但不同的法律规范下,“中国籍船舶”的内涵并不完全相同。国籍证书过期后,船舶仍具有国籍,直至海事管理机构予以注销。Despite the fact that the Maritime Traffic Safety Law and some other relevant domestic laws and regulations stipulate the rights and obligations of"Chinese ship",there are disputes over the definition of"Chinese ship",in particular concerning whether the ship with expired nationality certificate still has the Chinese nationality.The author believes that in the current domestic maritime administrative legal system,the connotation of"Chinese ship"belongs to legal norms.However,according to different legal norms,the connotation of"Chinese ship"is not exactly the same.After the nationality certificate expires,the ship still has the nationality until it is canceled by the maritime safety administration.
