家事程序立法的德系演变与中国选择

摘  要:我国家事审判改革提出“家事诉讼特别程序”的立法命题作为远景目标,2021年《民法典》婚姻家庭编与继承编的实施提出更加迫切的家事程序专门立法需求,欲加速推动其立法进程需要先确定立法模式和体例。德国家事程序原采“民事与家事程序合一立法模式”而行“家事诉讼与非讼二元分化体例”,2009年转采“家事程序单行立法模式”并创制“非讼化之一元统合体例”。它主导了现代家事程序立法的模式转向,间接促成日本“分立文本下之二元分化体例”的缔造,直接引领我国台湾地区“统一文本下之二元分化体例”的诞生,最终塑成三种家事程序单行立法体例的鼎立格局,可概称为家事程序立法的“德系”演变。我国未来,应当立足于现代家事程序立法模式的转向趋势,选择“家事程序单行立法模式”,采行“统一文本下之二元分化体例”。To achieve the long-range objective of Chinese family trial reform and satisfy the realistic demand of the Marriage Family Part and Inheritance Part in 2021 Chinese Civil Code,we must determine the model and style of legislation on Special Procedures for Family Proceedings to accelerate the legislative process.Before turning to Separate Legislation Model and creating Non-litigation Unification Style in 2009,German Family Procedure had been Civil-family Procedure Combination Legislation Model and Duality Differentiation Style between Litigation and Non-litigation Family Procedures.The German-style evolution indirectly caused Japan to set up the Duality Differentiation Style in Discrete Texts and directly led Chinese Taiwan to adopt the Duality Differentiation Style in Unified Text.It dominated the modern tendency of Family Procedure Legislation Model and finally created the tripartite confrontation situation of Separate Legislation Style.In the future,Chinese family procedure should choose the Separate Legislation Model and Duality Differentiation Style in Unified Text.
