控诉变更与审判范围的相互关系研究

摘　　要：控诉事实对审判范围具有限制作用,对于不利于被告人的事实,在未经控诉主体指控的情况下,法院不能纳入审判范围。控诉事实对审判范围的限制需要以诉讼客体是否出现变更为标准,如果案件事实的变化没有导致诉讼客体出现变更,无需通过控诉变更。法院不能超出控诉范围进行审判,但是需要就发现的新事实通知检察机关,由检察机关依职权决定是否进行公诉变更。审判范围还可能受到尚未提出控诉的漏罪事实的影响。检察机关对于案件的法律评价并不构成对审判范围的限制,但是对于案件审判也会产生重要影响。在法院作出不同于控诉主体法律评价的情况下,为了避免出现审判突袭现象,法院需要履行保障辩护权等诉讼权利的职责。致送法院对案件是否具有管辖权,应由法院依法作出决定。The facts of prosecution restrict the scope of adjudication.A court cannot adjudicate the facts unfavorable to the defendant if these facts are not included in the prosecution.The aforementioned restriction depends on whether the object in criminal proceeding is changed.If changed facts of a case will not lead to the change of object in the criminal proceeding,there is no need to change the prosecution.A court shall not try the facts beyond the scope of prosecution.Instead,it shall notify the procuratorate of the new facts found in trial,and the procuratorate shall decide whether to change the public prosecution according to its functions and powers.The scope of adjudication may also be affected by the crimes which have not been charged.The legal judgment by the procuratorate will not restrict the scope of adjudication but have a great impact on the trial.Where a court makes a legal judgment different from that made by the prosecutor,the court shall make the effort to protect the right to defense and other procedural rights,thus preventing surprise attack in trial.The court having received the bill of prosecution has the power to decide the jurisdiction issue of the case according to law.
