教学实习中校企共担工伤保险责任的制度构建

摘　　要：教学实习环节中,学生因工受伤的事故屡见不鲜,然而对于学生权益保护和校企责任承担的讨论仍未形成统一观点,国家层面的规定保持民法解决路径,而地方规范积极探索社会法救济手段。教学实习与其他实习类型的区别在于,教学实习由学校、实习单位和学生三方主体组成。通过分析三方主体的关系发现,学生身份的弱势地位需要强制性与兜底性兼具的工伤保险及时介入,校企的强势地位和安全保障义务为二者承担工伤保险责任提供法理支撑。在现有制度框架内,教学实习工伤保险的规则建构应当搁置实习生是否具有劳动关系的争论,将工伤保险责任交由校企共担,实习单位承担主要责任,学校以承担过错责任和不真正连带责任为限。It is not uncommon for accidents involving work-related injuries to students during teaching internships.However,there is still no unified view on the protection of student rights and the responsibility of schools and enterprises.At the national level,it is stipulated to maintain the civil law solution path,while local regulations actively explore the relief methods of social law.The difference between teaching internships and other types of internships lies in the fact that they are composed of three main parties:schools,internship units,and students.The disadvantaged status of students requires timely intervention of both mandatory and bottom-up work-related injury insurance;The strong position and safety protection obligations of schools and enterprises provide legal support for both parties to bear work-related injury insurance liability.Within the existing institutional framework,the debate over whether interns have a labor relationship should be shelved,and the responsibility for work-related injury insurance should be shared by schools and enterprises.The internship unit should bear the main responsibility,while the school should only bear fault liability and unreal joint liability.
