环境行政公益诉讼中确认违法判决的适用困境及其应对思路

摘　　要：《行政诉讼法》《<行政诉讼法>解释》《检察公益诉讼解释》虽规定了环境行政公益诉讼中确认违法判决的五种适用情形与两种适用样态,但既未规定确认违法判项与履行职责判项能够并用,也未对“检察建议前履职期”是否纳入确认违法的期间以及如何适用确认违法的起诉期限予以明确。确认违法判项与履行职责判项的错误并用、将“检察建议前履职期”不当纳入确认违法的期间以及确认违法判决的起诉期限适用淆乱致使环境行政公益诉讼中确认违法判决陷入适用困境。为了确保诉讼请求的准确性与实现裁判规则的统一性,建议对确认违法判项与履行职责判项的错误并用予以多维矫正,将“检察建议前履职期”剔除确认违法的期间以及对确认违法判决的起诉期限予以专门规定,以期逐一破解环境行政公益诉讼中确认违法判决的前述困境。Although the Administrative Litigation Law,the Interpretation of the Administrative Litigation Law,and the Interpretation of Prosecutorial Public Interest Litigation stipulate five applicable situations and two applicable modes for confirming illegal judgments in environmental administrative public interest litigation,they do not specify whether confirming of illegal judgments and the"performance of duties"judgments can be used together,nor do they clarify whether the"performance period before procuratorial suggestions"is included in the period for confirming illegal judgments and how to apply the prosecution period for confirming illegal judgments.The combination of confirming illegal judgments and"fulfilling responsibilities"judgments,improper inclusion of the"performance period before procuratorial advice"into the period of confirming illegal judgments,and confusion in the application of the prosecution period for confirming illegal judgments have led to a dilemma in the application of environmental administrative public interest litigation confirming illegal judgments.In order to ensure the accuracy of litigation requests and achieve the unity of judgment rules,it is recommended to apply multidimensional correction to the errors in confirming llegal judgments and"fulfilling responsibilities"judgments.The"performance period before procuratorial advice"should be excluded from the period of confirming illegal judgments,and special provisions should be made for the prosecution period of confirming illegal judgments,in order to solve the aforementioned difficulties of confirming illegal judgments in environmental administrative public interest litigation one by one.
