摘　　要：就针灸师行医中常见法律问题同一位具有丰富医疗案例审判经验的Diamond法官进行了对话和咨询,澄清了多个与针灸师密切相关的法律问题:在美国病人起诉医生一般从法院受理到结案大概需要6~7年;医生接到法院的传票后首先要通知保险公司,并保管好病历记录;针灸师被告的法律理由不是医疗事故(malpractice,误医),是渎职(Negligence);医患关系是从针灸师为患者提供医疗就开始了;针灸师不能避免被病人告;为了应对被告,最重要的是针灸医生要保存完整的病历记录;纽约州长颁布了一个对医务人员及机构在新型冠状病毒感染(新冠)期间免责令,只要医院或诊所认真执行美国疾病控制与预防中心(CDC)的有关预防措施,新冠期间诊所的雇员或病人,在上班或诊治期间得了新冠,医院或诊所将不承担法律责任;针灸师如果被告性骚扰,显然是非常严重的指控。The authors consulted with a former judge with many years of experience with medical cases in trial court and clarified the following legal issues that are of professional interest to acupuncturists.In the United States,it usually takes about 6~7 years from the time a patient sues a doctor in court to the conclusion of the case;After receiving a subpoena from a court,the doctor must first notify the insurance company and preserve all medical records;The primary legal reason for most lawsuits against acupuncturists is not malpractice,but negligence;The doctor-patient relationship begins when the acupuncturist provides medical treatment to the patient;Acupuncturists cannot avoid being sued by patients;In order to be prepared for a potential medical lawsuit,the most important thing is that the acupuncturist maintains a complete medical record;The governor of New York issued an exemption order for medical personnel and institutions during the corona virus disease 2019(COVID-19)pandemic period.As long as the hospital or clinic earnestly implements the relevant preventive measures of Centers for Disease Control and Prevention in the United States(CDC),the hospital or clinic will not be held legally responsible if an employee or patient of the clinic catches the COVID-19 during work or diagnosis and treatment during the COVID-19 period;If an acupuncturist is accused of sexual harassment,it is obviously a very serious allegation.
