中医药传统知识法律保护体系建构研究

摘　　要：关于中医药传统知识的保护,现行知识产权制度、非物质文化遗产保护体系以及保护生物多样性制度等难以起到显著作用,尤其是专利制度不仅无法保护处于“公有领域”的中医药传统知识,相反已然成为生物海盗行为的工具。中医传统知识保护的困境决定了中医药传统知识想要获得全面保护,必须采取积极性保护模式。建立中医药传统知识专门保护制度,确认中医药传统知识持有人的相关“财产权”,划定与现行知识产权保护体系的权利边界,可以有效实现中医药传统知识持有人和利用人之间的利益平衡,协调国内与国外专利授权的冲突,使中医药传统知识的法律保护能真正得到落实。The protection of traditional Chinese medicine knowledge,the current intellectual property rights system,the in-tangible cultural heritage protection system,and the biodiversity protection system are quite ineffective.The patent system can't protect the traditional Chinese medicine knowledge in the"public domain",it has facilitated the biological pi-rates'crimes instead.The plight of the protection of traditional Chinese medicine knowledge urges proactive protection measures for a wholesome protection.Establishing a special protection system for traditional Chinese medicine knowledge,recognizing the relevant"property rights"of holders of traditional Chinese medicine knowledge,and delineating the rights boundary with the current intellectual property protection system can effectively achieve a balance of interests between holders and users of traditional Chinese medicine knowledge,subdue the conflicts between domestic and foreign patent authorizations,and truly put into effect the legal protection system for traditional Chinese medicine knowledge.
