摘 要:抵押预告登记制度的合理适用,关乎我国住房金融市场的稳定与有序。《中华人民共和国民法典》第221条所规定的预告登记制度,应当被区分为所有权预告登记和抵押预告登记。所有权预告登记制度旨在保障所有权变动的顺利发生,故限于目的上的单向性、权利结构上的单重性及实现手段上的单一性,只能通过请求权的行使来确保权利的实现。基于抵押预告登记兼具担保物权和预告登记的性质,通过引入期待权理论,明确了权利人享有对预购商品房的支配权和对抗第三人的效力,以确保抵押预告登记之债权的实现。The notice registration system stipulated in Article 221 of the Civil Code should be di-vided into ownership notice registration and mortgage notice registration.The ownership notice reg-istration system aims to ensure the smooth transfer of ownership,which is limited to the one-way nature of the purpose,the singularity of the right structure,and the singularity of the means of im-plementation.The realization of rights can only be ensured through the exercise of the right to re-quest.With both the nature of security rights and advance notice registration,by introducing the theory of expectant rights,mortgage notice registration clarifies the control right of the obligee to the pre-purchased commercial housing and the effectiveness against third parties,therefore ensur-ing the realization of the creditor's rights in mortgage advance notice registration.
