摘　　要：在乡村振兴战略实施的背景下,允许宅基地使用权适度流转有助于充分激发宅基地的财产价值,促进我国珍稀土地资源的有效利用,从而为解决“三农”问题提供动力支撑。构建宅基地使用权流转制度的前提是,以中央政策为指引,不断汲取宅基地使用权流转试点工作的鲜活经验,直面农民群体希望宅基地使用权进行流转的现实需求。在制度的构建中,一要明确宅基地使用权流转主体的适用条件,不能触碰宅基地社会保障的底线;二要鼓励农民群体配合政府部门完成宅基地的确权、登记工作,为宅基地使用权的流转奠定基础;三要建立宅基地使用权流转市场,规范宅基地使用权流转程序;四要完善宅基地有偿退出机制,以不断完善的法律机制实现保障农民权益与节约土地资源的有效统一;五要建立宅基地使用权流转的监管体制,为宅基地使用权流转保驾护航。In the context of the implementation of the rural revitalization strategy,allowing the appropriate transfer of the right to use the homestead will help to fully stimulate the property value of the homestead and promote the effective use of rare land resources in China,thereby providing a driving force for solving the“three rural issues:agriculture,rural areas and farmers.”The prerequisite for constructing the transfer system is the guidance of the central policy.We should learn from the new experience of the pilot work of usufruct transfer and come face to face with the actual needs of farmers who want to transfer the usufruct.In constructing the system,1)it is necessary to clarify the applicable conditions for the subject of the usufruct transfer and not to touch the bottom line of the homestead as a means of social security;2)it is necessary to encourage farmers to cooperate with government departments to complete the confirmation and registration of homestead rights to lay the foundation for the usufruct transfer;3)it is necessary to establish a market for the circulation of homestead use rights and standardize the procedures for the transfer of usufruct;4)it is necessary to improve the mechanism for the paid withdrawal of homesteads,and realize the unity of protecting farmers’rights and interests and saving land resources by continuously improving legal mechanisms;and 5)it is necessary to establish a supervision system for the safe transfer of usufruct.
