摘　　要：协助组织卖淫行为在行为性质上区别于组织卖淫行为,是协助组织卖淫罪单独成罪的逻辑前提。协助组织卖淫罪的设定是立法上为避免组织卖淫罪刑罚过重而降低协助组织卖淫行为处罚力度的具体体现。立足于组织卖淫与协助组织卖淫行为的异质性,应合理界分组织卖淫罪从犯行为与协助组织卖淫行为。组织卖淫行为是指将多名卖淫女、嫖客整体或者系统促成交易的行为,而协助组织卖淫则属于间接的帮助组织卖淫行为,无法在整体或者系统上直接促成相关交易。The criminality of assisting in organizing prostitution differs from the criminality of organizing prosti⁃tution essentially.The former is the precondition of the crime of assisting in organizing prostitution being a sep⁃arate offense.The purpose of setting up this crime is to avoid applying the comparatively heavier penalty of the crime of organizing prostitution to those assisting in organizing prostitution.Based on the essential difference be⁃tween the two crimes,those criminalities could be separated clearly.The criminality of organizing prostitution is to prompt transactions between prostitutes and clients in whole or in part.The criminality of assisting in organi⁃zing prostitution,however,is a kind of indirect assistance for the criminality of organizing prostitution,which cannot prompt transactions between prostitutes and clients in whole or in part.
