摘 要:为保护和传承特色美食,各地都掀起了一股立法热潮,引发了人们的关注和质疑。民间规范和地方立法分属不同的规范体系,两者的互补性决定了地方立法离不开对民间规范的调制。同时,两者的差异性也决定了两者必然存在相互挤压、相互冲突的可能性。孟德斯鸠曾说:“节制是立法者的美德”。如何以节制性美德为目标指引,实现民间规范与地方立法的回环相生、和谐共处,具有十分重要的现实意义。基于此,本文拟从地方性知识理论出发,以特色美食立法为例,探讨民间规范融入地方立法的前提条件、路径规制及效果预期,进而厘清民间规范融入地方立法的节制性美德的具体内容和实现方式,为构建和谐有序的地方社会治理提供借鉴和启示。In order to protect and inherit special food,a wave of legislation has been launched in various places,which has aroused people's attention and doubts.Folk norms and local legislation belong to different normative systems.The complementarity of the two determines that local legislation cannot do without the modulation of folk norms.At the same time,their difference also determines the possibility of mutual squeeze and conflict between them.Montesquieu once said:"Moderation is the virtue of the legislator".How to use the moderation virtue as a guide,achieve the mutual generation and harmonious coexistence of folk norms and local legislation,has very important practical significance.Based on this,this paper intends to start from the theory of local knowledge,take the special food legislation as an example,discuss the prerequisite conditions,path regulation and result requirements of folk norms into local legislation,and then clarify the specific content and implementation methods of the moderation virtue of folk norms into local legislation,and provide reference and enlightenment for building a harmonious and orderly local social governance.
