摘 要:先秦平等观在当前的学界中有比较多的研究,但关于法家平等观的嬗变研究则稍有些不足。通过对法家平等观的发展梳理后,发现其可分为早中后三个阶段,探讨了三个重要的平等问题。早期的法家主要探讨平等的主体归属问题,中期的法家分析平等的维护问题,后期的法家思考平等的体系化问题。后期法家韩非融合并升华前人的理论,因时代原因也延伸出僵化和专制的倾向。先秦法家的理论主要随着这三个问题的探讨走向完善。Although there are many studies on the concept of equality in the Pre-Qin Dynasty,while there is less research on the historical evolution of the Legalism view of equality.After sorting out the development process of legalism concept of equality,it is found that the development of legalism is divided into three stages including three issues:the subject attribution in the early legalism,the maintenance in the middle stage,and the systematization by the later legalism.Han Fei integrated and sublimated the predecessors’theories,presenting the tendency towards rigidity and authoritarianism due to the times.The theory of pre-Qin legalism gets improved with the discussion of these three issues.
