摘 要:乡村振兴战略背景下,国家优惠政策逐渐向农村倾斜,土地的效益价值随着政策的出台水涨船高。在土地利益的驱动下农村土地承包纠纷集中爆发,且总体上呈起伏状的变化趋势。仲裁作为解决农村土地承包纠纷的解纷方式,虽然已经实施数十年,却存在仲裁人才供给不足、受案范围规定局限、程序设置可裁可审、机构设置行政化等问题。基于此,农村土地承包经营纠纷仲裁制度需要通过注重仲裁队伍建设、夯实纠纷适用基础、设置仲裁程序前置及定位仲裁机构性质等途径进行纾困,确保纠纷得以及时解决,从而为推进中国式农业农村现代化的高质量发展创造和谐稳定的社会环境。Under the background of rural revitalization,the national preferential policies are gradually tilted towards rural areas,and the benefit value of land has risen with the introduction of policies.Driven by land interests,rural land contract disputes broke out intensively,and generally showed ups and downs..As a dispute resolution method for rural land contract disputes,arbitration has been implemented for decades,but there are problems such as insufficient supply of arbitration talents,limited scope of accepting cases,procedural settings that can be arbitral and judicable,and administrative institutional settings.Based on this,the rural land contract arbitration system needs to be relieved by focusing on the construction of arbitration teams,consolidating the foundation for dispute application,setting up pre-arbitration procedure and positioning the nature of the arbitration institution,etc.,so as to ensure that disputes can be handled and resolved in a timely manner,and thus create a harmonious and stable social environment for the high-quality development of Chinese-style agricultural and rural modernization.
