摘 要:《民法典》和域外的经验告诉我们,单凭“提取公因式”的立法技术,容易导致片面强调规则适用的共同性,而忽视体系构造的共同性。我国《民法典》立法和实施过程中并未完全照搬“提取公因式”的立法技术,也适用了法律阶梯模式。探讨中国模式行政法法典化问题应避免揠苗助长、违反法典形成发展规律、无视行政单行法之间所具有的共同原理和原则。中国模式行政总则法的生成,应重视基础性的通则性规范提炼工作,使其形成行政通则法,最终生成行政总则法。应适时探索行政总则法与行政程序法的协同,为行政法典的制定提供有力的系统性、体系性保障。The Civil Code and extraterritorial experience tell us that relying solely on the legislative technique of extracting common causes can easily lead to a one-sided emphasis on the commonality of rule application while neglecting the commonality of system construction. The legislative and implementation process of China's Civil Code did not fully copy the legislative technique of extracting common causes, and also applied the legal ladder model. It should be noted that when exploring the issue of administrative codification in the Chinese model, we should avoid pushing things too far, violating the laws of the formation and development of the code, disregarding the common principles and principles among administrative separate laws, and moving towards the idea of compiling the general provisions of administrative law. The generation of the Chinese model administrative general principles law should attach importance to the extraction of basic general principles and norms, so as to form the administrative general principles law and ultimately generate the administrative general principles law. We should explore the synergy between the administrative general provisions law and the administrative procedure law in order to provide strong systematic and systematic guarantees for the formulation of the administrative code.
