电梯物联网背景下的乘客个人信息和通信秘密权利保护问题

摘　　要：本文在宪法框架下讨论了电梯轿厢内公共空间的界定,以及电梯内摄像头对乘客个人信息和隐私权侵犯的问题。分析了宪法对公民通信自由和通信秘密采取的法律保留方式的不足,梳理物联网背景下电梯乘客隐私侵权的新形态,提出将物联网服务商等纳入通信秘密侵权主体、强化个人信息保护法的执行和加强法律与技术性法规的协调等完善机制的建议。This paper discusses the definition of the public space in the elevator car under the framework of the Constitution,as well as the violation of the personal information and privacy of passengers by the camera in the elevator.This paper analyzes the shortcomings of the legal reservation methods adopted by the Constitution for citizens’freedom of communication and communication secrets,combs out the new forms of infringement of elevator passengers’privacy under the background of the Internet of Things,and puts forward some suggestions for improving the mechanism,such as including Internet of Things service providers into the main body of infringement of communication secrets,strengthening the implementation of the personal information protection law,and strengthening the coordination between laws and technical regulations.
